What is checked in legal due diligence before a property purchase in Bulgaria?
Before a purchase we check any outstanding taxes or utility debts, whether restitution claims affect the property, and its planning status and building permits. We also look at encumbrances (mortgages, easements, claims) and at the seller's title and chain of ownership in the Property Register. Most disputes in Bulgarian real estate transactions arise because due diligence was skipped.
Is a non-EU foreigner allowed to buy real estate in Bulgaria?
Non-EU nationals cannot buy land (agricultural, forest or regulated plots) in Bulgaria directly and must go through a Bulgarian company. They can buy apartments and buildings directly. EU citizens and their companies may buy every type of property. None of these rules limits the right to buy property within a building (apartment, office, shop).
How does a preliminary contract differ from a final contract in a property purchase?
The preliminary contract fixes the terms of the deal and is signed before the notarial deed, usually with a deposit paid. Where the seller does not perform, the buyer may ask a court to declare the contract final. The final contract is executed before a notary and passes ownership.
